The issues

MSA can work with BC committees in the much same manner we do with company boards of management.

Most body corporate committees will eventually face difficulties like the following:

      • failure to appreciate or understand the commercial nature of management contracts

      • maintaining harmony in a community

      • financial issues

      • maintaining impartiality

      • failure of owners/residents to observe the by-laws

      • misuse of visitor parking spaces and common property

      • disputes with owners, residents and tenants

      • problems with BC managers

      • poor relationships with managers, caretaking contractors or letting agents etc.

      • failure to issue instructions and notices in the correct manner

It is a long list and unfortunately many committees are composed of well meaning residents who are either unaware of the Body Corporate and Community Management Act 1997 or, are unaware of the process attached to administering their BC scheme. The bulk of owners do not wish to circumvent by-laws and often are not aware they are doing so.

A frequent complaint is that when disputes arise, the Commissioner's office favours managers. This is untrue... whilst the act can do with some upgrading, the commissioner is neutral. The issue may be that owners of management rights or caretaking and letting contracts will have a better understanding of the act than many committees and this leads to poor process in dealing with problems.
